Weekly letter to our Global Community 28 Jun 22

Dear EDRM Community,

The word of the week is horrified

We are seeking to understand how the US federal government must have the last word on open carry of guns and the states must have the last word on the very personal decisions made regarding pregnancy outcomes.  In a sign of our times, law enforcement and election officials have banded together in a nonpartisan effort toward protecting the safety of election workers. And civilian targets continue to be bombed in Ukraine, with no end in sight.

…prosecutors have relied on more concrete evidence like search histories, text messages and emails…

Kevin Collier quoting Cynthia Conti-Cook

In legal tech this week, Ina Fried reupped her article asking technology platforms about their data retention in light of new laws criminalizing pregnancy and trans care decisions.

Kevin Collier, covering security for NBC News, reports that prosecutors have relied on more concrete evidence like search histories, text messages and emails, quoting Cynthia Conti-Cook, a tech fellow at the Ford Foundation and the author of an influential study on abortion-related prosecutions and digital surveillance.

HIPAA does not protect information against warrants and subpoenas.

Ancestry.com and other DNA databanks offer a rich resource to identify the father to identify the other person financially responsible for a child on public assistance, or to identify the father in cases that might trigger an exception: rape or incest.

And Bloomberg’s Elizabeth Barnard looks at a milestone in proposed amendments US Federal Rule of Evidence 702 around expert witness credentials.
