Dear EDRM community,
The word for the week is regulation.
Tornados in Louisiana, an iceshelf the size of Los Angeles calving in Antarctica and another earthquake near Fukushima combined with combat near nuclear facilities bookend the shifts in weather and geopolitical patterns. International organizations are challenged to stop cities from being destroyed as civilians are killed and relocated. Rules around COVID prevention are scattered to the wind, leaving individuals, businesses and organizations to develop, socialize and enforce their own.
And we say goodbye for now, and thank you, to Mary Rechtoris and Mila Taylor of our Trusted Partner, Relativity’s Stellar Women.
Social media is struggling to keep up with gratuitous violent content and content posted by activists during war time. The US and the EU have agreed in principle on a new framework for cross border data flows, anticipating an Executive Order rather than legislation to implement, and focusing on rationales and remedies for US surveillance.
Competition with technology platforms is coming into its own, with the EU moving first with its Digital Markets Act mandating a level playing field, and upping the maximum penalty from the GDPR’s shocking 4% global turnover to 10% global turnover for a first offense and 20% for repeated violations. Ukranians and Russian dissidents are on “lists” and in danger of being rounded up—the very reason privacy laws are so strong in the EU given historical memory of the Stasi in World War II.
In legal tech this week, Bob Ambrogi reports that Hawaii has joined the states requiring technical competence for attorneys. (HT @ronfriedmann). Victoria Hudgins covers mental health in the legal tech profession.
