- Global Legal Tech Developments: OpenAI reported that AI models escaped a sandbox while testing offensive cyber capabilities by exploiting a zero-day vulnerability and accessing Hugging Face’s production infrastructure. Separately, Anthropic detailed incidents in which misconfigured evaluation environments allowed models to access organizations’ production systems without authorization. AI coding agents have also been escaping their sandboxes differently, as host tools trust files the agents write inside supposedly contained development environments. While security teams are evaluating the risks, the incidents are also raising legal and regulatory questions. Deliberate kinetic attacks on Middle East Amazon data centers earlier in the year and the ongoing attacks on Russia’s Wildberries have raised questions involving force majeure provisions. Looking farther down the horizon, Ralph Losey provided an overview of his new course introducing quantum law in “Quantum Law: AI, Quantum Computing, and the Future of Legal Judgment.”
- International eDiscovery Trends: Judge Andrew Peck (ret.), who wrote the opinion in Da Silva Moore, the first case that accepted TAR review, analyzed (with Reema Holz) the Schulte v. LinkedIn case, the first federal decision accepting generative AI for final responsiveness determinations in discovery. The Schulte case was discussed during HaystackID’s webcast “From Hype to Workflow: Insights from Experts on the Impact of AI on eDiscovery.” DISCO introduced an AI-native litigation platform combining case facts with case law. ComplexDiscovery analyzed Europe’s Article 50, California’s AI Transparency Act becoming operative, and the US Advisory Committee on Evidence Rules, which is convening a mini conference in the Fall to discuss approaches to deepfakes; ComplexDiscovery also offered practical suggestions for provenance maintenance in eDiscovery workflows. In preceding articles, ComplexDiscovery reported on governance and preservation challenges around AI generally with data from IBM and the Ponemon Institute and drilled down on the wave of water-utility PLC attacks across multiple states, noting potential preservation challenges as affected plants worked to maintain operations.
- World Events Impacting Legal Tech: The US Pentagon directed defense companies to accelerate weapons production to replenish depleted stores. Israel rejected the 15-point plan of the Board of Peace until Hamas completely disarms. Negotiations to reopen the Strait of Hormuz continued. Russia and Syria struck a new agreement for the management of military bases. The Houthis claimed attacks on an Aramco refinery and a Yemeni port, raising concerns about renewed civil war. Pakistan, Türkiye, and Saudi Arabia entered a mutual-defense pact. Typhoon Dolphin roiled Japan, China, and Taiwan. Europe continued to experience extreme heat and wildfires.
